ORDER

This petition is filed under Section 482 Cr.P.C., seeking to direct the Court below to release the petitioner/A2 on bail as per the order dated 11.09.2019 passed in Crl.M.P.No.473 of 2019 by the learned IX Additional Metropolitan Magistrate, Cyberabad, Kukatpally at Prasanthnagar.

While granting bail to the petitioner/A2, the Court below directed him to execute a personal bond for a sum of Rs.25,000/- with two sureties for a like sum each to the satisfaction of the said Court. During the course of acceptance of sureties, the Investigating Officer filed a report stating that the sureties submitted by the petitioner/A2 were not responding their phone call and they did not attend the Police Station for verification and that the petitioner/A2 is a Nigerian without any permanent address and if he is released on bail, it would be difficult for them to apprehend and that the other accused were absconding. Based on the said report, the Court below refused to accept the sureties and release the petitioner/A2 on bail.

3. As per the order impugned, the petitioner has to produce sufficient sureties to the satisfaction of the Court below. Since the Investigating Officer filed a report stating that the sureties could not attend the Police Station for verification, the petitioner/A2 shall furnish fresh sureties to the satisfaction of the Court below, and on furnishing the same, the Court below is directed to accept the same and release him on bail.

With the aforesaid direction, the Criminal Petition is disposed of.

Miscellaneous petitions, if any pending in this criminal petition, shall stand closed.
