HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.38170 of 2012 ORDER:

The petitioner states that he was falsely implicated in Crime No.107 of 2010 on the file of the 4th respondent. He was tried in S.C.No.182 of 2011 in the Court of the Sessions Judge, Guntur, and he was acquitted on 27.07.2011. However, the 4th respondent opened a rowdy sheet against the petitioner during the pendency of the above criminal proceedings. In view of opening of the rowdy sheet, the petitioner is being harassed by the police. Challenging the opening and continuing of the rowdy sheet, the petitioner filed the present writ petition.

A counter-affidavit is filed by the 4th respondent stating that the petitioner was involved in Crime No.107 of 2010 on the file of Tadikonda Police Station, Guntur District and he was acquitted on 29.07.2012 by the learned Sessions Judge, Guntur, in S.C.No.182 of 2011. At present, no fresh cases are registered against the petitioner. It was further stated in the counter-affidavit that after obtaining permission from the Additional Superintendent of Police, O.S.D. to North Sub Division, Guntur Urban District, a rowdy sheet was opened against the petitioner on 02.12.2011 and it was continued up to 31.12.2012.

In spite of granting sufficient time, no latest instructions have come up from the respondents.

In the circumstances, this Writ Petition is disposed of directing the 3rd respondent to review the case of the petitioner, if the rowdy sheet is being continued, and pass appropriate orders in accordance with law within a period of three months from the date of receipt of a copy of this order. If no rowdy sheet is being continued against the petitioner, he shall not be harassed by calling him to the Police Station unnecessarily. No order as to costs.
