ORDER

This writ petition was filed seeking to direct the respondents to conduct detailed enquiry about the irregular selections for the post of Veterinary Assistants as per notification dated 23.09.2015.

The petitioners who belong to weaker sections of the society & hailing from East Godavari District, completed two year Intermediate Vocational Dairying course conducted by the Board of Intermediate of A.P. They are eligible for the post of Veterinary Assistant as per the statutory rules issued under G.O.Ms.No.26, DH DD & F (AH-II) Department, dated 26.08.2004 and subsequent amendments. The State of Andhra Pradesh issued orders for filling up of 400 posts of Veterinary Assistants in East Godavari District under G.O.Ms.No.22, 17.8.2015 through direct recruitment. It was also made clear that selection process should be in accordance with G.O.Ms.No.60, AH, DD & F (AH.II) Department, dated 2.8.2011. As per the

said Government order, the method of selection is 80% of marks for written test and 20% marks as weightage to the marks obtained in the qualifying exam of the University. In pursuance of the same, the Joint Collector and the Selection Committee Chairman issued notification on 23.09.2015 inviting applications for 40 posts of Veterinary Assistants in East Godavari District and the petitioners applied for the same.

One of the petitioners made an application on 27.11.2015 under the Right to Information Act with regard to the selected candidates and after obtaining the same, they came to know that several irregularities have taken place in the selection process. The petitioners also state that the District Collector, East Godavari, appointed an Enquiry Committee and the same was published in 'Eenadu' News Paper. When no further action was taken, the present writ petition was filed.

Counter-affidavit is filed by the 4th respondent stating that the petitioners made a representation to the District Collector, East Godavari on 27.7.2016, and the Joint Director (AH), Kakinada, informing that there are certain

mistakes in correction of the answer sheets and on receipt of the same, the matter was brought to the notice of the Joint Collector, Chairman of the Selection Committee, Kakinada, who in turn, passed orders and appointed a four member committee for revaluation of the answer sheets as per the guidelines issued by the Director of Animal Husbandry, A.P., Hyderabad. It is further stated that 232 candidates have applied for 40 veterinary Assistant posts, 207 candidates appeared for the examination including the petitioners and 36 merit candidates have been selected by the Selection Committee. 16 selected candidates who have passed 2 year Veterinary Polytechnic Course have joined duty and other 20 candidates with the qualification other than polytechnic are undergoing one year training from 21.12.2015.

The petitioners did not figure in the merit list. Hence, they were not selected for the posts. The Committee completed the process of evaluation and submitted a detailed report to the Joint Collector and Chairman Selection Committee for further orders.

respondent is directed to call for report from the Joint Collector and take necessary action, in accordance with law, within a period of four weeks from the date of receipt of a copy of this order. It is needless to observe that if the 3rd respondent finds any irregularity in the selection process, he can direct the Joint Collector to issue a fresh notification by cancelling the appointment of the selected candidates after issuing due notice to them.

Accordingly, Writ Petition is disposed of. No costs. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed.
