HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.11339 of 2008 ORDER:
No representation on behalf of the petitioner who is appearing in person. Heard learned counsel for the respondent and perused the record. The present writ petition came to be filed seeking to declare the action of the respondent in reducing Bal Shree Awards for the year 2007 to the stream of Creative Writing to three awards by increasing the awards to other streams viz., Creative Art (14 awards i.e., four fold increase from previous years), Creative Scientific Innovation (14 awards i.e., three fold increase) and Creative Performance (12 awards i.e.
, 2 1⁄2 fold increase) from an average of 5 awards in each stream during the preceding years and also reducing the total awards from 60 to 50 as illegal and arbitrary and consequently direct the respondent to consider the case of the petitioner for Bal Shree Award in the Creative Writing stream for the year 2007 in case the petitioner is in top 13 of the merit list of Creative Writing stream. A perusal of the docket order dated 28.05.
2008 would disclose that this Court while issuing rule nisi, gave a direction to the respondent to re-consider the case of the petitioner for Bal Shree Award in Creative Writing stream for the year 2007, in case the petitioner is in the top 13 in the merit list of Creative Writing Stream, and if she is otherwise eligible, as per law, and pass appropriate orders within two weeks from the date of receipt of the order and communicate the same to the petitioner. Thereafter, the matter underwent couple of adjournments but there was no representation on behalf of the petitioner who is appearing in person. From the reading of interim order, it is clear that a direction was given to the respondent to consider the case of the petitioner, if she is otherwise eligible for the Bal Shree Awards in Creative Writing Stream for the year 2007.
A counter came to be filed by the respondent stating that in compliance of the interim order dated 28.05.2008, the respondent has passed speaking order which was duly communicated to the petitioner. It is stated that the case of the petitioner could not be considered for Bal Shree Award, as her position is not in No.13 in the merit list for Creative Writing Stream.

In view of the above, nothing survives for adjudication at this stage and accordingly the writ petition is dismissed. No costs. Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed.
