THE HON'BLE SRI JUSTICE T.AMARNATH GOUD M.A.C.M.A. No.3577 OF 2019 JUDGMENT:

This appeal is filed by the appellants/claimants aggrieved by the Order and Decree dated 31.12.2018 passed in M.V.O.P.No.12 of 2018 by the Motor Accidents Claims Tribunalcum-XII Additional Chief Judge, City Civil Court, at Secunderabad (for short, the Tribunal).

For the sake of convenience, the parties are hereinafter referred to as they were arrayed before the Tribunal in the original petition.

Heard Sri Vladimeer Khatoon, learned counsel appearing for the appellants/claimants. Perused the material record. 4.

At the time of hearing, learned counsel for the appellants/claimants stated that the subject matter in the present appeal has already been decided by this Court in MACMA.Nos.882 & of by judgment, dated 02.01.2019, wherein the 5th respondent-M/s. Reliance General Insurance Company Limited has filed MACMA.No.882 of 2019 and the 3rd respondent-M/s. United India Insurance Company Limited has filed MACMA.No.1411 of 2019 challenging the impugned order and decree, dated 31.12.2018, in M.V.O.P.No.12 of 2018 and this Court, after hearing learned counsel for both sides, has partly allowed the MACMA.Nos.882 & 1411 of 2019 by reducing the compensation amount from Rs.12,15,000/- to

TA,J MACMA.No.3577 of 2019 Rs.7,45,000/- and the rate of interest is also reduced from 9% to 7.5% per annum from the date of petition till realization, vide judgment, dated 02.01.2020. Now the present appeal is filed by the claimants in M.V.O.P.No.12 of 2018 seeking enhancement of the compensation.

Since the MACMA.Nos.882 & 1411 of 2019 filed by the insurance companies have been partly allowed by giving detailed reasons, I do not find any reason to enhance the compensation. Hence, nothing survives for adjudication in this appeal. 6.

Accordingly, the appeal is dismissed. There shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this appeal shall stand closed.
