THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.33394 of 2015 ORDER:

Despite the matter being adjourned twice to enable the learned Assistant Government Pleaders for Revenue and Mines & Geology to get instructions, they state that they were unable to do so. The short grievance of the petitioner was that his application dated 21.02.2012 for grant of a mining lease is kept pending for want of a No Objection Certificate (NOC) in terms of G.O.Ms.No.2, Revenue (Assignments.I) Department, dated 02.01.2013. Under Clause 6 thereof, a new procedure has been prescribed for issuance of a NOC by way of a joint inspection. The complaint of the petitioner is that no steps are being taken in terms of this new procedure for issuing a NOC for further processing of his mining lease application. As the Government has introduced a new scheme under G.O.Ms.No.2 dated 02.01.2013, it is for the authorities specified thereunder to undertake joint inspection for the purpose of issuing the NOC. The petitioner's application is dated 21.02.2012 and as yet no steps have been taken pursuant thereto in terms of the new procedure.

The Writ Petition is accordingly disposed of directing the authorities concerned to consider and process the petitioner's application under G.O.Ms.No.2 dated 02.01.2013 read with G.O.Ms.No.181, Industries & Commerce (Mines.I) Department, dated 28.05.1998. This exercise shall be completed expeditiously and in

any event, not later than one month from the date of receipt of a copy of this order.

Pending miscellaneous petitions, if any, shall also stand closed in the light of this final order. No order as to costs. ____________________ SANJAY KUMAR, J 13th NOVEMBER, 2015.
