O R D E R

Learned counsel appearing for both parties are at consensus that the issue arising in this writ petition fell for consideration before this Court in W.A. No.791 of 2008 and batch which was allowed by a Division Bench of this Court by common order dated 05.09.2013. A copy of the said order is placed on record.

In terms of the aforestated order and for the reasons alike as were mentioned therein, this writ petition is allowed to the extent indicated hereunder.

The impugned memo dated 08.08.2007 is set aside. There shall be a direction to the respondents to reinstate the petitioner in service forthwith, with continuity of service, but without any back wages. Pending miscellaneous petitions shall stand closed. No order as to costs.
