HON'BLE SRI JUSTICE VILAS V.AFZULPURKAR W.P.No.32191 of 2015 ORDER:

Heard.

The petitioner herein was successful in awarding retail outlet MS/SHD dealership at location between Chelmada Hospital and Mugdampur on SH-1, Karimnagar District. The petitioner states that the land owner executed registered lease deed in his favour for a period of 21 years, but the said land owner died in an accident on 2701-2015 and his legal representatives have been objecting to the works carried out by the petitioner at the location and also objecting the Government officials. On account of continuous objections by the legal heirs of the landowner, the petitioner has filed a representation before the 2nd respondent on 14-07-2015 seeking to change location between Chelmanda Anand Rao Hospital and Mughampur in view of subsequent events.

Learned counsel for the petitioner submits that the alternative site now proposed is adjacent to the approved location, where the petitioner was awarded retail outlet and there is no impediment for the respondents to consider the petitioner's request. The present writ petition is filed complaining of nonconsideration of the said representation by the 2nd respondent. Sri Srikanth Kaveti, learned Standing Counsel for the respondents, who has taken notice, has obtained instructions and submits that the petitioner's representation would be considered by the 2nd respondent expeditiously. In view of that, the writ petition is disposed of directing the 2nd respondent to look into the aforesaid representation of the petitioner and pass appropriate orders expeditiously, preferably within four weeks from the date of receipt of a copy of this order. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
