THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 5841 OF 2017 O R D E R :

Show cause notice dated 28.12.2016 issued by the 3rd respondent Zonal Commissioner, Anakapalle Zone, Greater Visakhapatnam Municipal Corporation directing the petitioner to stop the work that is being carried on at premises bearing D.No. 8-14-1/1, Gurajada Public School, Ring Road, Anakapalle forthwith, is challenged in this Writ Petition. The case of the petitioner is that pursuant to the show cause notice, he has submitted the detailed explanation, raising certain objections on 31.01.2017, enclosing thereto the necessary documents.

Heard learned counsel for the petitioner as well as Sri K. Lakshminarayana Reddy, learned Standing Counsel for the respondent Corporation.

Inasmuch as the petitioner has already submitted his explanation to the show cause notice dated 28.12.2016, the respondent Corporation is directed to consider the same and pass appropriate orders thereon. Till such time necessary orders are passed, specifically dealing with the objections raised by the petitioner, no coercive action shall be taken against the constructions raised in the premises afore-stated. With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
