Heard the learned counsel for the petitioners, learned Government Pleader for Revenue appearing for respondent Nos.1 to 5, learned Government Pleader for Home appearing for respondent No.6 and Sri K.Srinivas, learned counsel representing respondent Nos.7 and 8. 2.

In this Writ Petition, the petitioners have impugned proceedings dt.17-11-2015 of 4th respondent cancelling the house site patta allotted to the petitioners' father in the year 1993 on the ground that no construction of house has been done by the petitioners' father or by the petitioners. It is stated that an appeal has been preferred before 3rd respondent by the petitioners challenging the said order and that the said appeal is pending consideration.

Learned counsel for the petitioners contends that even before the expiry of the appeal period of 30 days, which should be counted from the date of service of the order passed by 4th respondent, in great haste, 4th respondent issued house site patta in respect of the subject plot to 8th respondent.

This fact is not seriously contested by the respondents.

Therefore, the Writ Petition is disposed of directing 3rd respondent to decide the appeal filed by the petitioners within three months from the date of receipt of a copy of this order after providing a personal hearing to the petitioners as well as respondent Nos.7 and 8 in accordance with law and communicate his decision thereon to both sides. Pending disposal of the appeal, there shall be interim suspension of proceedings dt.17-112015 of 4th respondent. No costs. 6.

As a sequel, the miscellaneous petitions, if any pending, shall stand closed.
