THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.12792 of 2013 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.142 of 2013 on the file of the Yellareddypet Police Station, Karimnagar District, registered for the offences punishable under Section 498-A I.P.C. and Section 4 of Dowry Prohibition Act.

When the matter is taken up for hearing, it is informed by the learned Public Prosecutor that the charge-sheet was already filed in this case and hence nothing survives for adjudication in the Criminal Petition.

Since the charge-sheet has already been filed, the Criminal Petition has become infructuous. However, the petitioner is at liberty to challenge the charge-sheet, if she so desires.

It is informed by the learned counsel for the petitioner that warrants are pending against the petitioner before the trial Court.

The petitioner is directed to surrender before the Magistrate concerned and file petition to recall the warrants issued against her. Upon filing of such petition, the trial Court is directed to recall the warrants, pending against the

petitioner, on the same day on her executing a personal bond for a sum of Rs.5,000/- (Rupees Five thousand only) with one surety for a like sum to the satisfaction of the said Magistrate. Further, the petitioner-accused is directed to report before the trial Court on all hearing days.
