HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9137 of 2016 ORDER:

This petition is filed by the petitioner - Accused under Section 438 of Criminal Procedure Code seeking to grant bail to him in Crime No.58 of 2016 of Atmakur Police Station, SPSR Nellore District, registered for the offences punishable under Sections 3 of the PDPP Act, 20 and 29 of the A.P. Forest Act, 447, 427, 379 and 120-b of IPC. Heard and perused the material available on record. The allegation against the petitioner is that he along with other accused were found transporting red sandal woods, illegally. Learned counsel for the petitioner submitted that there is no specific allegation against the petitioner that he was found in possession of red sanders and he was falsely implicated in the case. Learned Additional Public Prosecutor opposed this petition. In view of the gravity of the allegations against the petitioner, this Court is not inclined to grant anticipatory bail to him.
