HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.1991 of 2017 ORDER :

This criminal petition is filed under Section 438 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') to enlarge the petitioner/sole accused on bail in the event of his arrest in connection with Crime No.85 of 2017 of Saroornagar Police Station, Rachakonda, registered for the offence punishable under Section 195-A IPC.

After arguing the matter elaborately, learned counsel for the petitioner, requested to direct the Station House Officer, Saroornagar Police Station, to issue notice under Section 41-A of the Cr.P.C. and also follow the guidelines issued by the Hon'ble Apex Court in Arnesh Kumar v. State of Bihar1 3.

Acceding to the request of the learned counsel for the petitioner, without going into the merits of the case, I deem it appropriate to direct the Station House Officer, Saroornagar Police Station, Rachakonda, to follow the procedure under Section 41-A of Cr.P.C. and guidelines issued in Arnesh Kumar's case supra. 4.

With the above observation, the criminal petition is disposed of. 5.
