HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION NO.27820 OF 2019 ORDER:

This writ petition is filed seeking the following relief: "..to issue a Writ, Order or Direction, more in the nature of Writ of Mandamus declaring the action of the Nodal Authority, Warangal and the Integrated Tribal Development Agency (ITDA), Eturunagaram, rep. by its Chairman, Mulugu District under G.O.Ms.No.24 TW (LTR-1) Department, dated 12.06.2018 in not sending genuine local ST Candidates to Telangana State Public Service Commission for filling up of remaining 65 vacancies of Forest Beat Officers in pursuance to the recruitment notification No.48 of 2017 dated 15.08.2017 as illegal, arbitrary, violation of Articles 14, 16 and 21 of the Constitution of India and consequently direct the District Collector, Warangal-Urban District to forthwith send the list of local ST Certificates to the Telangana State Public Service Commission for issuance of appointment orders as Forest Beat Officer forthwith and to pass such other order or orders as this Hon'ble High Court may deem fit and proper in the circumstances of the case."

Heard learned counsel for the parties.

It has been contended by the petitioners that after undergoing regular selection process, they have been selected to the post of Forest Beat Officer pursuant to the recruitment notification No.48 of 2017 dated 15.08.2017. The grievance of the petitioners is that their case for appointment to the post of Forest Beat Officer is not being considered only on the ground that verification process as regards the genuineness of the 'Local Scheduled Area Certificates' possessed by

AKS,J W.P.No.27820_2019 them is not being completed by the respondents, and even after long lapse of time, the respondents are not completing the said verification. Therefore, counsel for the petitioners contends that appropriate orders be passed in the writ petition directing the respondents to complete the verification process as regards the genuineness of the Local Scheduled Area Certificates possessed by the petitioners within a reasonable period of time and also to consider the case of the petitioners for appointment to the post of Forest Beat Officer, if the Local Scheduled Area Certificates of the petitioners are found to be genuine in the enquiry.

Government Pleader appearing for the respondents had contended that re-verification process of the Local Scheduled Area Certificates of the petitioners is pending before the Revenue Divisional Officer and the respondents would complete the said process within a reasonable period of time, preferably within eight weeks from today.

This Court, having considered the submissions of learned counsel for respective parties, is of the considered view that this writ petition can be disposed of directing the respondents to complete the re-verification process of Local Scheduled Area Certificates possessed by the petitioners within a period of eight weeks, and if the Local Scheduled Area Certificates of the petitioners are found to be genuine, the respondents shall consider the case of the petitioners for appointment to the post of Forest Beat Officer in accordance with law.
