THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION NO.8109 OF 2022 ORDER:

This Criminal Petition is filed under Sections 437 and 439 of Code of Criminal Procedure, 1973 (for short "Cr.P.C") seeking regular bail to the petitioners/Accused Nos.1, 2 and 5 in connection with Crime No.92/2022 on the file of Hadnoor Police Station, Sangareddy District, registered for the offences punishable under Sections 341, 307 and 506 read with 34 of Indian Penal Code.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The petitioners and the defacto complainant are neighbours. With regard to land there was an altercation in between both the parties. On 21.06.2022, both the accused group and the complainant group quarreled with each other and persons from both the sides received injuries and a crime registered against these petitioners vide crime No.92 of 2022 and on the basis of the complaint all these petitioners, Crime No.93/2022 was registered against the complainant and others.

As seen from the remand report, the injuries sustained by the defacto complainant were treated and he was discharged. Since all these petitioners are in jail since 12.07.2022 and the altercation is the outcome of dispute regarding land, these petitioners can be granted the relief of bail subject to the following conditions:

i) The petitioners/A1, A2 and A5 shall execute personal bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties for a like sum each to the satisfaction of Judicial First Class Magistrate at Zaheerabad.

ii) The petitioners/ A1, A2 and A5, after release shall appear before the concerned Station House Officer on every Monday between 10.00 A.M. to 1.00 P.M. for a period of eight weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation. iii) The petitioners/ A1, A2 and A5 shall abide by the other conditions stipulated in Section 437(3) of Cr.P.C. 5.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
