THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.14699 of 2017 ORDER:

This Writ Petition is filed by the respondent/accused and the surety in M.C.No.A/280/2017/Rajapet challenging the notice dated 27.03.2017 issued by the second respondent asking the petitioners herein to pay the penalty of Rs.1,00,000/- or to show cause within seven days for not paying the said amount.

After receipt of the notice, the petitioners did not submit any explanation, but filed the present Writ Petition challenging the notice. Since an opportunity is given to the petitioners to show cause for not paying the amount of penalty imposed on the petitioners, this Court feels that no direction can be issued to the respondents at this stage, as an opportunity was given to the petitioners. In the circumstances, this Writ Petition is disposed of giving liberty to the petitioners to submit the explanation to the said show cause notice, though belatedly, within a period of one week from the date of receipt of a copy of this order, and on receipt of such explanation, the second respondent shall pass appropriate orders in accordance with law. The miscellaneous petitions pending in this Writ Petition, if any, shall stand closed. There shall be no order as to costs.
