HON'BLE SRI JUSTICE R.KANTHA RAO Writ Petition No.31954 of 2015 Order:

Heard Sri S.A.K. Mynoddin, learned counsel appearing for the petitioner and the learned Government Pleader for Women Development and Child Welfare for the respondents.

2. The petitioner is the Anganwadi Worker of Cumbum village in Prakasam district. On health grounds, she applied for leave and the leaves were granted. Ultimately, on 193-2015 the Child Development Project Officer-4th respondent passed an order removing the petitioner from duties. The order does not indicate any reason for the removal of the petitioner. It only shows that as per the directions of the Collector, Prakasam district, the 4th respondent passed the impugned order. Since the impugned order is not supported by any reason, it is liable to be set aside.

3. Accordingly, the writ petition is disposed of. The order dated 19-3-2015 passed by the 4th respondent removing the petitioner from duties is set aside.

The respondents are directed to admit the petitioner to duties and continue her in the post of Anganwadi Worker. However, this order does not preclude the appropriate authority to conduct an enquiry against the petitioner and pass appropriate orders in accordance with law.

The miscellaneous petitions, if any, pending in this writ petition shall stand closed. No costs.
