THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.1801 OF 2017 ORDER:

Petitioner complains against seizing lorry bearing Nos. AP 29 T 9745 and AP 29 TB 3175 as illegal and unconstitutional and seeks release of the vehicles in terms of G.O.Ms.No.3, Industries & Commerce (Mines-I) Department, dated 08.01.2015 and G.O.Ms.No.15, Industries and Commerce (Mines-I) Department, dated 19.02.2015.

On instructions, the Assistant Government Pleader for Home, submits that the subject vehicles have been deposited before the concerned Magistrate. Since the vehicles are deposited with the Court of competent jurisdiction, the petitioner has to move the Court for appropriate reliefs.

By granting liberty to file application for release of vehicles, the writ petition is disposed of. Policy decision is taken in G.O.Ms.No.3, dated 08.01.2015 and G.O.Ms.No.15, dated 19.02.2015 for release of vehicles. The petitioner is given liberty to bring the policy decision to the notice of the Court, when his application is considered for release of vehicles. 4.
