THE HONOURABLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.46452 OF 2016 O R D E R :

Heard counsel for the petitioner and Sri A.Sanjeev Kumar, Standing Counsel for respondents 1 and 2.

Counsel on both sides agree that the issue raised in this Writ Petition is covered by the order dt.30.11.2016 in W.P.No.27450 of 2003.

Therefore, for reasons alike, this Writ Petition is also disposed of with the following directions:

a) The respondents, namely Hindustan Cables Limited, shall furnish the particulars of all payments made to the individual petitioners, within a period of 15 days from the date of receipt of the copy of the order. Such particulars shall be posted to the addresses of the petitioners left with the Hindustan Cables Limited. It shall also open for the petitioners to collect the particulars individually, if they so want.

b) It shall be open to the petitioners to submit their individual claims under various heads, furnishing the details as to the amounts due from the respondents according to their calculations. Such representations can be made within a period of 15 days from the date of receiving the particulars from the respondents.

c) On receiving such particulars/representations from the individual petitioners, the respondents shall pass appropriate orders within one month there from, indicating the reasons for withholding any amount or denying the benefits as claimed by the petitioners. So far the undisputed amounts are concerned, the respondents shall pay the same within a period of two months from the date of receipt of the representations from the petitioners.

Inasmuch as the directions referred to above, are only directed against the Hindustan Cables Limited. It is clarified that no liability as such is fastened to any other respondents, including the Government of India. There shall be no order as to costs.

Consequently, miscellaneous Petitions pending if any, shall stand closed.
