THE HON'BLE SRI JUSTICE T. VINOD KUMAR Writ Petition No.27839 of 2019 ORDER:

The present writ petition is filed to declare the action of the 4th respondent-Sub. Inspector of Police, Huzurnagar Police Station, Suryapet District, in threatening the petitioner with dire consequences and calling him to the police station on a false report and not closing the FIR No.314 of 2019 of Huzurnagar Police Station, as being illegal, arbitrary and against the principles of natural justice.

Heard Smt. Kandarpa Vani, learned counsel for the petitioner and the learned Assistant Government Pleader for Home appearing for the respondents.

The learned Assistant Government Pleader for Home on written instructions dated 16.12.2019 submits that based on the complaint made by the father of the petitioner, a case was registered in Crime No.314 of 2019 of Huzurnagar Police Station on 05.12.2019 under Section Woman missing. It is stated in the written instructions that during the course of investigation, it disclosed that the missing woman, who is the petitioner herein, went to her husband's house and as such after recording the statement of missing woman, case will be finalized.

Having regard to the said submissions made on behalf of the respondents, the learned counsel for the petitioner

submits that the petitioner will approach the respondent authorities for recording the statement, within a period of two weeks from the date of receipt of a copy of this order, whereupon the authorities can close the FIR No.314 of 2019. However, it is made clear that respondent authorities shall not interfere with the life and liberty of the petitioner, till the case is finalized.

Subject to the above observation and direction, the writ petition is closed. However, there shall be no order as to costs.

As a sequel thereto, Miscellaneous Applications, if any, pending in this writ petition shall stand closed. However, there shall be no order as to costs.
