ORDER:- Heard learned counsel for the petitioner, learned Government Pleader for Revenue appearing for the respondents 1, 2 & 5 and learned Government Pleader for Municipal Administration and Urban Development appearing for the 3rd respondent. With the consent of both the parties, the main writ petition is heard and disposed of at the admission stage itself.
The present writ petition came to be filed seeking issuance of a writ of mandamus declaring the action of the respondents 1 to 5 in not conducting survey of the petitioner's land situated in the premises bearing door No.8-133, Opposite Post Office, M.R.O. Office Road, Jaggaiahpeta, Krishna District, as illegal and arbitrary.
Learned counsel for the petitioner mainly submits that though the petitioner made a representation dated 20.08.2011 to the 2nd respondent by marking copies to the respondents 1 & 3 to 5 seeking survey of his land, till date no action has been initiated by any one of them.
Learned Government Pleader for Revenue, on oral
instructions, submits that if the petitioner pays the requisite fee for survey of his land, the 5th respondent may be directed to conduct the survey, as per law.
Having regard to the circumstances stated above and without going into the merits of the case, the 5th respondent is directed to consider the representation dated 20.08.2011 made by the petitioner and conduct survey of his land on payment of requisite fee, after giving notice to the petitioner as well as the 6th respondent, in accordance with law, at the earliest. With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.
Consequently, miscellaneous petitions, if any, pending in the writ petition shall also stand closed.
