THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.399 OF 2016 ORDER:

This criminal petition under Section 438 of the Code of Criminal Procedure is filed by the petitioner/A.2 seeking anticipatory bail in crime No.85 of 2015 on the file of the P.S., Ongole I Town, Prakasam District, registered for the offences under Sections 387, 389 read with Section 34 IPC.

Heard and perused.

The allegation against the petitioner herein is that the petitioner/A.2 and A.1 collected money from the de facto complainant to invest in granite business and that they failed to invest the same and when the complainant demanded to repay the amount, they failed to repay the same and thus, committed the offences. Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in the crime. Learned Public Prosecutor submits that the petitioner is having eight previous cases of the same nature and also whenever the respondent/police are trying to arrest the petitioner, she tried to commit suicide in order to avoid arrest.

Considering the facts and circumstances of the case, this Court is not inclined to grant anticipatory bail to the petitioner herein. The criminal petition is accordingly dismissed. _____________________ JUSTICE RAJA ELANGO 01.02.2016 pln
