THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.36756 OF 2016 ORDER:

The writ petition is filed by the petitioners seeking a writ of certiorari declaring the action of the second respondent in registration of crime No.190 of 2016 on the file of the second respondent as illegal and arbitrary, and consequently, to call for the records in connection with crime No.190 of 2016 and quash the same.

Heard and perused the material.

Learned counsel for the petitioners submits that the third respondent has filed the complaint without any valid grounds and that the second respondent has registered the said complaint being crime No.190 of 2016. He further submits that it is purely a civil dispute, however, the second respondent is interfering with the civil disputes between the petitioners and the third respondent, and as such, he prays this Court to quash the same. Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the second respondent is not interfering with the disputes between the petitioner and the third respondent and that he is proceeding in accordance with law.

Considering the rival submissions made by both the counsel, the second respondent is directed not to interfere in the civil disputes between the petitioners and the third respondent. The second respondent is further directed to follow the due process of law laid down in Code of Criminal Procedure.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 31.10.2016 pln
