Heard Sri Y.Ramatirtha, learned counsel for the petitioner, learned Government Pleader for Panchayat Raj and Rural Development (A.P.) appearing for respondent No.1 and Sri Ravi Cheemalapati, learned Standing Counsel appearing for respondent Nos.2 and 3.

The grievance of the petitioner in the present writ petition is the alleged proposal by respondent Nos.2 and 3 to lay a road through the petitioner's site situated in R.S.No.250/1 of Marellamudi Village, Nallajerla Mandal, West Godavari District. 3.

A counter-affidavit deposed by the Panchayat Secretary of the respondent Gram Panchayat is filed and at paragraph No.11 of the said counter, it is stated that the Gram Panchayat has no intention to lay the road, as such, the question of acquiring the land does not arise.

The said statement in the counter-affidavit is placed on record.

Recording the said statement, the Writ Petition stands disposed of. There shall be no order as to costs. 6.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
