HONOURABLE SRI JUSTICE A. RAMALINGESWARA RAO WRIT PETITION No. 13126 of 2016 ORDER:

All the petitioners are working as Additional Assistant Engineers in the respondent-Company at various places. It is their case that Regulation No.30-A Part.1 of APSEB Service Regulations provides for payment of higher time scale of pay when the incumbents are holding additional charge. When the same was not considered, the present Writ Petition is filed seeking a direction to comply with Regulation No. 30-A of the APSEB Regulations.

This Court considered the issue in respect of retired Junior Accounts officers and disposed of Writ Petition No. 9307 of 2010 by order dated 23.03.2016. While disposing of the said Writ Petition, this Court based its decision on the order dated

28.03.2006 passed by this Court in Writ Petition No. 1085 of 2006 which was confirmed by the Division Bench of this Court in Writ Appeal No. 683 of 2010 through order dated 06.09.2010. It is also observed that SLP preferred against the said order in SLP.NO.848 of 2012 was dismissed by the Honourable Supreme Court on 30.07.2014.

In view of the same, the respondents are directed to verify the record with regard to discharge of additional duties by the petitioners during the periods mentioned by them and issue orders for payment of amounts in accordance with Regulation No. 30-A of the APSEB Regulations within a period of three months from the date of receipt of a copy of this order. The Writ Petition is accordingly disposed of. Miscellaneous petitions pending consideration if any in the Writ Petition shall stand closed in consequence. No order as to costs.
