This petition is filed for a writ of Mandamus declaring the action of 4th respondent in trying to sell petitioner's Lorry bearing No.TS 06 Ub 2619 by issuing Sale Notice dated 26.05.2018, as illegal and arbitrary and to set aside the same and for a consequential direction to the 2nd respondent to release the said vehicle to the petitioner from respondents 3 to 5.
Heard learned counsel for the petitioner.
Sri G.Kalyan Chakravarthi, learned Standing Counsel appearing for respondents 3 to 5 submits that petitioner purchased the subject vehicle by obtaining loan from them; that as he committed default in paying EMIs regularly, as per the terms and conditions of the loan agreement, his vehicle was seized. He further submits that petitioner has already approached the District Consumer Forum, Mahabubnagar, in respect of his grievance by filing IA.No.6/2017 in CC.No.8/2017; and that the Consumer Forum has passed orders.
Learned Assistant Government Pleader for Home produced written instructions stating that they are not interfering with the business of the petitioner.
As petitioner has already approached District Consumer Forum in respect of his grievance, no relief can be granted against respondents 3 to 5.
In view of the same and recording the aforesaid submission made by the learned Assistant Government Pleader, the writ petition is disposed of. No order as to costs.
