HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Criminal Revision Case No.2124 OF 2016 ORDER:
Heard both sides and perused the material on record. For implementation of the order in Crl.M.P.No.5277 of 2014 of the lower Court, dated 18.06.2015 where the signatures of the P.W.3 K.Madhusudhan Reddy are required, the petition in Crl.M.P.No.2245 of 2015 on 05.10.2015 should not have been dismissed even otherwise dismissed, as the Court got the power having allowed the petition in Crl.M.P.No.5277 of 2014 to issue summons to secure his presence if not produced by anybody. Thereby there is nothing to interfere with the impugned order of the lower appellate Court in Crl.R.P.No.183 of 2015 dated 31.05.2016 for setting aside the lower Court's order in Crl.M.P.No.2245 of 2015 dated 05.10.2015 but for to say for implementing the orders, the learned Magistrate shall make every endeavour for disposal of the DVC, otherwise can seek extension of time fixed by this Court in CRP No.1505 of 2015 dated 01.09.2015. In the result, the revision is dismissed. There is no order as to costs. Pending miscellaneous petitions, if any in this revision, shall stand closed.
