This writ petition is filed to declare the action of the respondents in issuing Memo No.9600/CV.2/2011, dated 29.05.2018, whereby the 1st respondent vacated the interim stay granted on 08.02.2012 in the appeal filed against the order passed by the 2nd respondent, vide Rc.No.D3/-3104/2008, dated 16.03.2011, as highly illegal and arbitrary. 2.

Heard the learned counsel for the petitioner and the learned Government Pleader for Social Welfare.

It is claimed by the petitioner that, being aggrieved by the impugned proceedings, dated 29.05.2018, the petitioner has filed an application/representation, dated 30.10.2019, before the 1st respondent seeking restoration of the interim order granted earlier on 08.02.2012. Further, it is also stated by the said representation that the petitioner claims to have raised additional grounds on account of bifurcation of the State and the merging of some of the Mandals with East Godavari District in the State of Andhra Pradesh.

Learned Government Pleader on instructions submits that, acting on the representation filed by the petitioner, the 1st respondent fixed a date for hearing, on 01.02.2020, whereat the petitioner is at liberty to appear and raise all the grounds which he intends to take. 5.

Having regard to the said submission made, since a date has been fixed for hearing acting on the representation of the petitioner dated 30.10.2019, this Court is of the view that the 1st respondent shall consider

all the pleas taken by the petitioner on the said date of hearing and decide the matter in accordance with law.

Subject to the above observation, the writ petition is disposed of. Pending miscellaneous petitions, if any, shall stand closed in the light of this final order. No order as to costs.
