HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.9683 of 2013 ORDER:

This writ petition is filed seeking a direction to the respondents to take action on the representation of the petitioner dated 19.3.2013 and consequently to direct the respondents to remove all encroachments made on 33 feet wide road i.e. Dycus Road,Kotamitta, Nellore Town, SPSR Nellore District.

The case of the petitioner is that the municipality has taken over the land opposite to the house of the petitioner for developing park and constructed compound wall and erected a gate; on 15.3.2013, some unknown persons started levelling the land and trying to occupy the road margin; the petitioner made a representation to the 1st respondent on 19.3.2013 and as the 1st respondent did not dispose of the same, the present writ petition is filed.

Learned Standing Counsel for the 1st respondent submits that the representation dated 19.3.2013 is still pending with the 1st respondent and the 1st respondent will consider the same.

In view of the submissions made by the learned Standing Counsel for the 1st respondent, the 1st respondent is directed to consider and dispose of the representation of the petitioner dated 19.3.2013, if not already disposed of, and communicate the same to the petitioner, as expeditiously as possible.

With the above directions, the Writ Petition is disposed of. No order as to costs.
