THE HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.20735 OF 2016 ORDER:

This Writ Petition is filed seeking to declare the action of respondent No.4 in evicting the petitioners from the lands admeasuring Ac.9-62 cents, Ac.4-50 cents and Ac.8-86 cents covered by Survey Nos.371, 368-1 and 369, respectively, situated at Sreerangapuram Village, Beluguppa Mandal, Anantapur District, without issuing any notice, as illegal and arbitrary.

2. The case of the petitioners is that they are in possession and enjoyment of the subject lands having being purchased the same from the declarants. As the subject lands were included in surrendered lands by the declarants, the Land Reforms Tribunal, Anantapur, vide proceedings in C.C.Nos.3085 and 3358/75/KLG, dated 27.06.1990, accepted surrender of the subject lands by the declarants. Having come to know about the same, they preferred L.R.A.Nos.5 and 6 of 1991 before the Land Reforms Appellate Tribunal, Anantapur, but the same were rejected. Aggrieved by the same, they preferred C.R.P.Nos.3952 and 4102 of 1999 before this Court and the same were allowed setting aside the orders of the Primary Tribunal, dated 27.06.1990, as well as that of the appellate Tribunal, dated 01.09.1999, and the matter was remanded for fresh enquiry. In pursuance of the same,

notice, dated 30.04.2016, was issued to produce the documents and they produced the same. Thereafter, the matter was adjourned for want of C.C. records. Though no orders are passed by the Primary Tribunal, the respondents are trying to interfere with their possession in respect of the subject lands. Hence, the present Writ Petition is filed.

3. Heard learned counsel for the petitioner and learned Assistant Government Pleader for Revenue.

4. In view of the facts and circumstances of the case, since enquiry is stated to be pending before the Primary Tribunal, till final orders are passed by the Tribunal, the respondents are directed not to interfere with the possession of the petitioners in respect of the subject lands.

5. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition, shall stand closed. No costs. __________________________ A. RAJASHEKER REDDY, J June 28, 2016 Note: Issue C.C. by tomorrow.
