HONOURABLE SRI JUSTICE P. NAVEEN RAO WRIT PETITION No. 21452 of 2015 ORAL ORDER:

This writ petition is filed seeking a direction to Commissioner, Greater Hyderabad Municipal Corporation- second respondent to take control of management of tennis court at Bhuvana Vijayam Playgrounds, KPHB colony, Hyderabad.

2. Heard the learned counsel for petitioner and learned standing counsel for GHMC and with their consent the writ petition is taken up for disposal at the stage of admission.

3. Petitioner claims to be a tennis player. He states that second respondent developed a playground in KPHB colony popularly known as 'Bhuvana Vijayam grounds' wherein two tennis courts are developed one for children and another for adults and maintaining the same by providing lighting and water facility etc. The petitioner alleges that the third respondent is a society registered under the provisions of Society Registration Act, 2001 and without obtaining any permission or authorization from second respondent it is controlling the playing activities of tennis courts by collecting fee.

4. Though several allegations are made against third respondent, learned counsel for petitioner submitted that it would suffice to dispose of the writ petition directing the fourth respondent to pass appropriate orders on the legal notice dated 21.4.2015 treating it as representation.

5. Having regard to the same, without expressing any opinion on the merits of the matter, writ petition is disposed of directing the fourth respondent to treat the legal notice dated 21.4.2015 as representation of the petitioner, consider the same and after affording reasonable opportunity to third respondent society, pass appropriate orders as warranted by law within a period of four weeks from the date of receipt of copy of this order and communicate the decision to the parties.
