THE HON'BLE SRI JUSTICE M.S.K.JAISWAL CRL.P.NO.9998 OF 2016

O R D E R

This criminal petition is filed under Section 482 Cr.P.C. seeking to quash the proceedings in C.C.No.588/2012 on the file of IV Additional Chief Metropolitan Magistrate, Vijayawada, registered against the petitioner/accused No.2 for the alleged offences punishable under Sections 418 read with 114 IPC.

Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

A perusal of the material on record reveals that specific allegations were made against the petitioner. The truth or otherwise of the allegations can only be decided during course of trial. I see no ground to interdict at this stage and quash the proceedings.

In the facts and circumstances of the case and as requested by the learned counsel for the petitioner, the criminal petition is disposed of, directing the trial court to dispose of the case as expeditiously as possible, without insisting the presence of the petitioner/ accused No.2, on each and every date of adjournment, unless required for any specific purpose. Miscellaneous petitions pending if any, shall stand closed. No costs. ------------------------------ M.S.K.JAISWAL,J DATE:13.07.2016 AVS
