THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA ORDER: (per Hon'ble The Chief Justice Sri Kalyan Jyoti Sengupta) The statements and averments made in the contempt application are insufficient for initiating contempt proceedings with regard to the alleged violation of the order of payment of interest on the pension amount. We think that in view of the subsequent developments, we cannot hold that there has been any deliberate violation of the order of the Court because it
appears that the alleged contemnors have not violated the same. Therefore, the contempt proceedings are dropped. However, liberty is given to take steps in accordance with law in view of the subsequent developments for obtaining appropriate and suitable directions so that the relief sought for in the contempt proceedings, if not already received, can be obtained. The contempt case is accordingly closed. Pending miscellaneous petitions, if any, shall also stand closed. No order as to costs. ______________________ K.J.
