Heard.
As the proviso amended to Section 142 of the N.I.Act by Act 55 of 2002 w.e.f.06.02.2003, confers discretion on the court, even the complaint filed beyond period of one month from approval of cause of action, to consider for condonation of delay and as trial court even dismissed, lower appellate court saying not properly exercised the discretion, that too instead of deciding on merits, by default dismissal of the delay condonation application, since allowed on costs of Rs.2,000/-, that order impugned in the revision no way requires interference.
Accordingly the revision is disposed of before admission by granting 15 days time to the accused from now to get ready for proceeding with the trial. Miscellaneous petitions pending, if any, in this case shall stand closed. _____________________________ DR.B.SIVA SANKARA RAO,J 10.04.2017 SS
