Heard the learned Counsel for the petitioner and the learned Government Pleader for the respondents.
The petitioner is the owner of two wheeler, viz., Fassion Plus - Hero Motor Bike bearing No.AP 7AD 8911. The 3rd respondent, after conducting panchanama, seized the said vehicle near the F.P.Shop No.4 belonging to the father of the petitioner on the ground that the vehicle was used for carrying rice for clandestine activity. The petitioner filed application dated 20.07.2015 before the 2nd respondent for release of vehicle. As no orders are passed so far, the petitioner filed the present writ petition.
Having regard to the fact that the petitioner has already filed an application before the 2nd respondent for release of vehicle, this Court feels that this is a fit case to direct the 2nd respondents to release the vehicle bearing No.AP 7AD 8911, subject to the petitioner furnishing bank guarantee for a sum of Rs.20,000/- (Rupees twenty thousand only), within a period of two weeks from the date of receipt of a copy of this order. It is made clear that the petitioner shall file an undertaking that he will not transfer or alienate the vehicle in favour of third parties and produce the same as and when required by the 2nd respondent. It is needless to mention that the bank guarantee furnished would be subject to further orders passed by the 2nd respondent. The Writ Petition is, accordingly, disposed of.
The miscellaneous petitions pending, if any, shall stand closed. There shall
be no order as to costs.
