THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No.24479 OF 2017 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking to issue a writ of Mandamus to declare the action of respondent No.4 in regularly calling the petitioner to police station and interfering in the civil suits i.e., O.S.No.420 of 2017 on the file of VII Junior Civil Judge, City Civil Court, Hyderabad and O.S.No.1660 of 2017 on the file of the II Junior Civil Judge, City Civil Court, Hyderabad to compromise the civil disputes by misusing his official power and threatening to implicate the petitioner and her family members in false and frivolous criminal cases as illegal and arbitrary and consequently, direct respondent Nos.3 and 4 not to call the petitioner and her family members to the police station.

Though various grounds are raised in the writ petition, learned counsel for the petitioner mainly states that respondent Nos.3 and 4 are regularly calling the petitioner and her family members to the police station and interfering in the civil disputes. 3.

Learned Government Pleader for Home (Telangana) opposed the same stating that a case has been registered against the petitioner and in pursuance of the same, notice under Section 41-A Cr.P.C. was also issued. According to him, respondent Nos.3 and 4 are not interfering with the personal life and liberty of the petitioner and her family members.

Having regard to the statements made across the Bar by both the counsel and taking into consideration the averments made in the affidavit filed in support of the writ petition, the respondent police are directed not to summon the petitioner and her family members to the police station and interfere in the civil disputes, except in accordance with the procedure established by law.

Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
