THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.17308 OF 2016 ORDER:

Heard both sides and with consent of the counsel appearing for both sides, the present writ petition is disposed of at the admission stage.

2. Since this Court is not going into the merits of the issue, giving notice to respondents 6 and 7 may not be necessary.

3. The grievance of the petitioner appears that the 2nd respondent and his staff are illegally and intentionally calling the petitioner to the police station for settlement of a civil dispute with regard to title and possession of house site bearing Plot No.34 in Sy.No.101 admeasuring 114 square yards situated at Medipally Village, Ghatkesar Mandal, Ranga Reddy District.

4. The case of the petitioner is that the petitioner is a registered General Power of Attorney (GPA) Holder for dealing with the above mentioned plot, which belongs to respondent No.6. Subsequently, the said plot was sold to respondent No.7 under a registered sale deed vide document No.610 of 2016 dated 20.01.2016 before respondent No.5 after compliance of all statutory requirements. It is alleged that respondent No.7, with a view to grab away some amounts from the petitioner, by colluding with the respondents-police, frequently calling the petitioner to the police station and threatening to implicate him in a criminal case. It is said that no crime is registered against the petitioner till date.

Having regard to the circumstances stated above, the Writ Petition is disposed of directing the respondents-police to be mindful of the limits of their jurisdiction in criminal law and shall proceed in accordance with law while summoning the petitioner to the police station or arresting the petitioner in the event of a crime being registered against him. Needless to mention that the respondents shall follow the due process and proceed in accordance with law.

Consequently, Miscellaneous Petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs.
