THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL MISCELLANEOUS APPEAL No.711 OF 2018 ORDER:

This civil miscellaneous appeal is filed by the appellantdefendant No.5 under Order XLIII Rules 1 and 2 of CPC, assailing the order dated 27.4.2018 passed in I.A. No.481 of 2017 in A.S.No.37 of 2017 on the file of the Court of VI Additional District Judge, Markapur.

At the time of hearing, the only relief sought by the learned counsel for the appellant is to direct the first appellate Court to dispose of the appeal as early as possible. In view of the said submission, this Court is not inclined to go into merits of the main case.

Having regard to the facts and circumstances of the case and the submission made by the learned counsel for the appellant, the learned VI Additional District Judge, Markapur is hereby directed to dispose of A.S.No.37 of 2017 as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.

With the above direction, the civil miscellaneous appeal is disposed of. Miscellaneous petitions if any pending in this appeal shall stand closed.
