HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.26270 OF 2003

ORDER

This writ petition is filed seeking to issue a Writ of Mandamus directing the respondent-Corporation to consider and pass appropriate orders on the representation of the petitioner dated 7.6.2002.

Heard Sri T.Venugopal Rao, learned counsel appearing for the petitioner and Sri N.Vasudeva Reddy, Learned Standing Counsel appearing for the respondent-Corporation. The grievance of the petitioner is that as the stagnation increments were not released to him, he submitted a representation dated 7.6.2002 to the respondent-Corporation, but so far no orders have been passed thereon. Learned Standing Counsel appearing for the respondent-Corporation submits that the petitioner has already retired from service and hence, the cause in this writ petition does not survive for adjudication.

Having considered the rival submissions made by the learned counsel on either side, this Court is of the considered view that ends of justice would be met if a direction is issued to the respondent-Corporation to consider the representation dated 7.6.2002 submitted by the petitioner.

Accordingly, the Writ Petition is disposed of directing the respondent-Corporation to consider the representation dated 7.6.2002 submitted by the petitioner and pass appropriate orders thereon within a period of four weeks from the date of receipt of a copy of this order, if not already disposed of. No costs.

Miscellaneous petitions, if any, pending shall stand closed.
