JUDGMENT:

The appeal arises out of judgment and decree, dated 24.04.2003, in O.S.No.60 of 1980 on the file of the learned Senior Civil Judge, Narsapur. The respondent in the appeal filed AS.MP.No.760 of 2015 stating that the lower Court has decreed the suit for specific performance of agreement of sale in her favour and that feeling aggrieved by the said judgment, the appellant has filed the above appeal. It is further stated that recently both the parties agreed to settle the dispute, as per which, the respondent has received a sum of Rs.9,00,000/- on 17.04.2015 as full and final settlement of her claim and that accordingly a Memorandum of compromise was executed on 20.04.2015. At the hearing, both the appellant and the respondent are personally present and they are duly represented by their respective counsel. Both the parties have affirmed the compromise entered by them.

In the light of the above facts, AS.MP.No.760 of 2015 is allowed. AS.No.1213 of 2003 is allowed by setting aside the judgment and decree, dated 24.04.2003, in O.S.No.60 of 1998, on the file of the learned Senior Civil Judge, Narsapur. As a sequel to disposal of the appeal, AS.MP.No.12920 of 2003 shall stand disposed of as infructuous.
