THE HON'BLE SRI JUSTICE T. SUNIL CHOWDARY CIVIL REVISION PETITION No.5720 OF 2016 ORDER:
This Civil Revision Petition, under Article 227 of the Constitution of India is filed assailing the inaction on the part of the Special Assistant Agent and Sub-Divisional Magistrate, Mobile Court, Bhadrachalam, Khammam District.
Heard the learned counsel for the petitioner. A perusal of the record reveals that the petitioner filed O.S.No.154 of 2016 on the file of the Special Assistant Agent and Sub-Divisional Magistrate, Mobile Court, Bhadrachalam, Khammam District seeking perpetual injunction against the respondents in respect of an extent of Ac.2-34 guntas in Sy.No.199 situated at Pusugudem village of Vulakalapalli Mandal, Khammam District. Along with the suit, the petitioner also filed I.A.No.195 of 2016 seeking ad-interim injunction. The trial Court granted ad-interim injunction in favour of the petitioner on 15.07.2016 restraining the respondent form interfering with the plaint schedule property. It is the case of the petitioner that in spite of the interim order, the respondents are interfering with the suit schedule property. The petitioner filed I.A.No.334 of 2016 on 28.07.2016 seeking police protection.
The grievance of the petitioner is that the learned Special Assistant Agent and Sub-Divisional Magistrate is not disposing of the said I.A.
Having regard to the facts and circumstances of the case, the learned Special Assistant Agent and Sub-Divisional Magistrate, Mobile
Court, Bhadrachalam, Khammam District is hereby directed to dispose of the I.A.No.334 of 2016 in I.A.No.195 of 2016 in O.S.No.154 of 2016 as expeditiously as possible, preferably, within a period of two months from the date of receipt of a copy of this order. Accordingly, this Civil Revision Petition is disposed of. No order as to costs.
