O R D E R

Aggrieved by the action of the 3rd respondent - Administrative Officer, City Criminal Courts, Nampally at Hyderabad, in commencing destruction of Cr.No.326 of 2002, the present writ petition is filed. Learned Assistant Government Pleader for Home produced written instructions of the 8th respondent -Sub Inspector of Police, Jubilee Hills Police Station, stating that the accused in Cr.No.326 of 2002, approached High Court in W.P.No.21422 of 2002. Though this court initially granted interim stay of investigation by order dated 25.11.2002, eventually disposed of the writ petition on 26.09.2014 directing the investigating agency to speed up the investigation in the case. The investigation is in progress and it requires some time for filing final report before the court. It is stated that they are ready and willing to supply a copy of the FIR to the petitioner for perusal. Since it is stated that the FIR in the above said crime is available and the 8th respondent is ready and will to provide copy to the petitioner for perusal, the grievance of the petitioner stood redressed.

When this court questioned about the locus standi of the petitioner to question the destruction work, learned counsel for the petitioner submits that the petitioner is not personally interested in the matter. If that is the case, petitioner ought to have filed public interest litigation, but he cannot maintain the present writ petition.

Since the FIR in the above said Crime No.326 of 2002, is stated to be available and the 8th respondent is ready and willing to provide a copy the petitioner, writ petition is disposed of giving liberty to the petitioner to file

necessary application, and on filing of such application, 8th respondent is directed to furnish a copy of the same to the petitioner. With the above direction, writ petition is disposed of.
