HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.24832 OF 2009 ORDER:

This writ petition is filed in relation to the Notice in Lr.No.R.I/497/2004, dated 01.11.2009, wherein the petitioner is directed to vacate Shop No.22, situated at Ravindra Bharathi Nagar, Nearby Bhongir Gunj, Bhongir, Nalgonda District. 2.

Heard learned counsel for the petitioner and Sri N.Praveen Kumar, learned standing counsel for Municipality. 3.

In the counter affidavit filed by the Commissioner, Bhongir Municipality, it is categorically stated that, as a matter of fact, petitioner had vacated the shop and the same was allotted to one A.Kiran Kumar, in the month of November, 2009. The counter affidavit is filed on 19.04.2011. No reply affidavit is filed refuting the specific assertion in the counter affidavit.

In those circumstances, the relief claimed in the writ petition becomes infructuous and nothing survives for further adjudication. 4.

Accordingly, this writ petition is dismissed as infructuous. Miscellaneous petitions pending consideration, if any, in this case shall stand closed as a consequence. There shall be no order as to costs.
