HON'BLE SRI JUSTICE T. AMARNATH GOUD WRIT PETITION No.27865 of 2019 ORDER :

This writ petition is filed seeking Mandamus to declare action of the respondents in not considering for grant of Building Permission for construction of residential building in open Plot No.467, in an extent of 266.66 sq. yards in Sy.No.561, situated at A.N. Reddy Colony, Shastrinagar, Nirmal Mandal, Nirmal District, as the same does not come under cut-off date of Layout Regularisation Scheme, 2015 as per G.O.Ms.No.151, dt.02.11.2015, as arbitrary and illegal and consequently sought a direction to respondent No.2 to grant Building Permission for construction of residential building in the said premises. Heard Sri C. Naresh Reddy, learned counsel for the petitioner, as well as the learned Government Pleader for Municipal Administration and Urban Development and Sri N. Praveen Kumar, learned Standing Counsel for respondent No.2 - Nirmal Municipality.

It is submitted by the learned counsel for the respective parties that the issue involved in this writ petition is squarely covered by order dt.20.02.2018 in W.P.No.3240 of 2018.

TA, J W.P.No.27865 of 2019 Accordingly and for the reasons alike, this Writ Petition is also disposed of directing respondent No.2 to grant Building Permission for construction of residential building in open Plot No.467, in an extent of 266.66 sq. yards in Sy.No.561, situated at A.N. Reddy Colony, Shastrinagar, Nirmal Mandal, Nirmal District, by extending benefit of the scheme to the petitioner, subject to fulfilment of the requirement criteria on its own merits, within a period of four weeks from the date of receipt of a copy of this order. No order as to costs.

As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
