THE HON'BLE SRI JUSTICE RAMESH RANGANATHAN AND THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY Writ Petition No.14944 of 2005 ORDER: (per Hon'ble Sri Justice Ramesh Ranganathan) Despite service of notice, neither the 1st respondent nor the 2nd respondent has filed counter affidavit.

The petitioner's grievance in this writ petition is of encroachment of a public road by the 2nd respondent and thereby causing inconvenience to the people living in the area including the petitioner herein. The petitioner submitted a representation to the 1st respondent on 13.06.2005, a copy of which is enclosed along with the writ petition. Public road vests with the Municipal Corporation and any encroachment thereupon must be removed after following the procedure prescribed by law. As the petitioner had earlier submitted a representation on 13.06.

2005, ends of justice would be met if the petitioner is permitted to submit another representation within four weeks from today and, on such representation being filed, the 1st respondent shall, after putting the 2nd respondent on notice and giving him an opportunity of being heard, pass orders in accordance with law within three months from the date of such representation and communicate the said order to the petitioner. The writ petition stands disposed of accordingly. The miscellaneous petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
