HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.6423 of 2017 ORDER:

This criminal petition is filed, by the petitioners-accused Nos.2 and 3, under Section 438 Cr.P.C., seeking pre-arrest bail in Crime No.178 of 2017 on the file of Station House Officer, Shadnagar Police Station, Cyberabad District, registered for the offences punishable under Sections 498-A and 306 IPC. 2.

Learned counsel for the petitioners strenuously submitted that the petitioners, who are in-laws of the deceased, were falsely implicated in this case. He further submitted that accused No.1 has surrendered before the Court concerned. The learned Additional Public Prosecutor opposed the bail petition. 3.

A perusal of the record reveals that the petitioners herein along with others filed Crl.P.No.3759 of 2017 and the same was dismissed by this Court on 10.07.2017 so far as the petitioners herein and accused No.1 are concerned on the ground that the investigation is in progress.

Learned Addition Public Prosecutor submitted that the investigation is in progress. A perusal of the record reveals that there are no changed circumstances from the date of dismissal of earlier bail petition to till date. Taking into consideration the nature of offences alleged to have been committed by the petitioners and the stage of the investigation, this Court is of the considered view that it is not a fit case to grant pre-arrest bail to the petitioners.
