HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WP No.24456 of 2018 ORDER:

This writ petition is filed challenging the proceedings dated 19-04-2018 passed by the 1st respondent in directing the petitioner-company to set aside the proposal to shift their present office premises at Teachers colony, Thirumulgiry, Secunderabad to West Marredpally, Secunderabad, on the ground that such shifting of office amounted to change of conditions of service of the workman of the petitionercompany, as being without jurisdiction, arbitrary, illegal and beyond the powers of the 1st respondent and consequently to set aside the same.

Learned counsel for the petitioner submits that the impugned order passed is without jurisdiction as the existing office premises of the petitioner-company had to be shifted to West Marredpally as the lease period in respect of the premises at Thirumulgiry expired and the petitioner could not get extension of the lease. It is stated that even otherwise, shifting of office is only for administrative convenience and not

to settle scores with the workers who raised an industrial dispute against the petitioner-company.

Learned Asst. Government Pleader for Labour, on the other hand, produced written instructions and on a perusal of the same goes to show that the 1st respondent has no jurisdiction to pass impugned order.

In that view of the matter, the impugned order is set aside on the ground of lack of jurisdiction on the part of the 1st respondent. In the result, the writ petition is allowed. Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
