THE HON'BLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.10055 of 2023 ORDER:

This Criminal Petition is filed under Section 438 of Cr.P.C. by the petitioners/Accused Nos.2 and 3 seeking bail in the event of their arrest in connection with Crime No.127 of 2023 on the file of Karepalli Police Station, Khammam, registered for the offence under Section 307 of IPC. 2.

Heard learned counsel for the petitioners and learned Assistant Public Prosecutor for the respondent-State and perused the record.

The allegation of the de-facto complainant is that these petitioners and A-1 have attacked his brother due to previous enemity.

All the three accused have beaten him indiscriminately resulting in head injury and loss of blood. 4.

On instructions, learned Additional Public Prosecutor would submit that there is one injury on the head which was received by the brother of the de-facto complainant namely Bhagwan.

Keeping in view that there was one injury which was inflicted on the victim and the specific allegation is against A-1,

these petitioners can be granted the relief of anticipatory bail, subject to the following conditions:

1) The petitioners/Accused Nos.2 and 3 are directed to surrender before the Station House Officer, Karepalli Police Station, Khammam District, on or before 19.10.2023. On such surrender, the said Station House Officer shall release the petitioners on bail, on their executing personal bond for a sum of Rs.25,000/- (Rupees Twenty Five thousand only) with two sureties for a like sum each to his satisfaction.

2) On such release, petitioners/Accused Nos.2 and 3 shall appear before the concerned Station House for the purpose of investigation at 10:00 a.m. on every Monday for a period of eight weeks and thereafter, as and when required.

3) The petitioners/Accused Nos.2 and 3 shall abide by the other conditions stipulated in Section 438(2) of Cr.P.C and shall co-operate with the Investigating Officer in investigating the case.

Accordingly, this Criminal Petition is allowed.

Miscellaneous applications, if any pending in this criminal petition, shall stand closed.
