THE HON'BLE SRI JUSTICE P.NAVEEN RAO CONTEMPT CASE No.2013 of 2014 ORDER :

With reference to the claim of the 2nd petitioner on his entitlement to get disability pension, the 2nd petitioner submitted representation on 09.12.2013 to the District Collector, Mahabubnagar District. Alleging that the said representation was not considered and no orders are passed, the petitioners filed W.P.No.3089 of 2014. By order dated 03.03.2014 the writ petition was disposed of directing the District Collector, Mahabubnagar (2nd respondent) to consider the representation of the 2nd petitioner dated 09.12.2013 and take action thereon with reference to the entitlement of the 2nd petitioner to get pension and pass appropriate orders.

2. Learned Assistant Government Pleader, produced proceedings dated 17.12.2014 which was communicated to the 2nd petitioner, wherein the 2nd petitioner was informed that as per the medical examination conducted on 08.12.2014 he was found to be having less than 40% disability and therefore, not entitled to claim disability pension.

3. Having regard to the above, as the order of this Court is complied with by the respondent, I do not see any justification to proceed against the respondent in this contempt case.

However, liberty is granted to the petitioners to work out their remedies as available under law against the decision of the District Collector, Mahabubnagar.

4. Accordingly, the Contempt Case is closed. There shall be no order as to costs.

5. Miscellaneous petitions, if any, pending in this Contempt Case shall stand closed.
