This writ petition is filed assailing the order dated 05-072018 whereby and whereunder the 2nd respondent disallowed the re-appeal of the petitioner, who is a student of National Institute of Fashion Technology, Hyderabad campus-3rd respondent. The matter pertains to non-awarding of marks and aggrieved thereby the petitioner applied for re-jury, which was disallowed against which appeal filed, and that was also disallowed and aggrieved further re-appeal was filed, by the order impugned in this writ petition that was also disallowed. 2.

Heard the learned counsel for the petitioner and learned counsel representing learned Assistant Solicitor General for the respondents. Perused the impugned order.

The matter was listed on 17-07-2018, 24-07-2018 and 26-07-2018. Learned counsel representing learned Addl. Solicitor General seeks further time to file counter in the matter.

A perusal of the impugned order goes to show that it is a non-speaking order and no reasons whatsoever are given in disallowing the case of the petitioner, and it is clear case of non-application of mind on the part of the 2nd respondentappellate authority. On the this short ground alone the impugned order dated 05-07-2018 passed by the 2nd respondent is set aside. In the circumstances, the 2nd

respondent is directed to re-consider the matter and pass appropriate orders in accordance with law by giving reasons. In the meanwhile, as it is stated that the academic year started, it is open for the petitioner to join the 7th semester, however, such permission granted to the petitioner is subject to the orders to be passed by the 2nd respondent. 5.

With the above directions, the writ petition is disposed of accordingly. As a sequel to the disposal of the writ petition, miscellaneous petitions if any pending shall also stand closed. There shall be no order as to costs.
